ALERT:USCIS Announces Final Rule for T Nonimmigrant Status

On April 29, 2024, USCIS announced afinal rule amending regulations on applications forT nonimmigrant status. T nonimmigrant status enables certain victims of human trafficking to remain in the United States for an initial period of up to four years. The rule will be effective onAug. 28, 2024. For more information, see our News Release.

Use this form to request temporary immigration benefits if you are a victim of a severe form of trafficking in persons, also known as human trafficking.

Edition Date

04/01/24. Starting Aug. 28, 2024, we will accept only the 04/01/24 edition of Form I-914; Form I-914, Supplement A; and Form I-914, Supplement B. From June 3, 2024, to Aug. 27, 2024, we will accept the 04/01/24 or 12/02/21 edition of Form I-914 that is filed with either the 12/02/21 or the 04/01/24 edition of Form I-914, Supplement A and Supplement B.

Dates are listed in mm/dd/yy format.

If you complete and print this form to mail it, make sure that the form edition date and page numbers are visible at the bottom of all pages and that all pages are from the same form edition. If any of the form’s pages are missing or are from a different form edition, we may reject your form.

As required by federal regulations, all applications filed with USCIS must be properly completed, submitted, and executed in accordance with the applicable form instructions. See 8 CFR 103.2(a)(1); 8 CFR 103.2(b)(1).

Checklist of Required Initial Evidence (for informational purposes only)

Please do not submit this checklist with your Form I-914. The checklist is an optional tool to use as you prepare your form, but does not replace statutory, regulatory, and form instruction requirements. We recommend that you review these requirements before completing and submitting your form.Do not send original documents unless specifically requested in the form instructions or applicable regulations.

If you submit any documents (copies or original documents, if requested) in a foreign language, you must include a full English translation along with a certification from the translator verifying that the translation is complete and accurate, and that they are competent to translate from the foreign language into English.

Did you provide the following?

  • A personal statement;
  • Evidence you are or have been a victim of a severe form of trafficking in persons;
  • Evidence you are physically present in the United States, American Samoa, Commonwealth of the Northern Mariana Islands, or at a port of entry, as a result of trafficking. This includes physical presence based on your having been allowed entry into the United States to participate in investigative or judicial processes associated with an act or a perpetrator of trafficking;
  • Evidence you have complied with any reasonable request for assistance in a federal, state, or local law enforcement investigation or prosecution of acts of trafficking, unless you were under 18 years of age at the time of victimization, or you are unable to cooperate with a request due to physical or psychological trauma;
  • Evidence you would suffer extreme hardship involving unusual and severe harm upon removal;
  • If you are inadmissible, an application for a waiver of inadmissibility on Form I-192;
  • Credible documentation of the claimed relationship if you are filing Form I-914 Supplement A for an eligible family member;
  • If you are filing for your parent, unmarried siblings under 18 years of age, or an adult or minor child of your derivative who faces a present danger of retaliation based on your escape from the severe form of trafficking in persons or cooperation with law enforcement, you should include the following:
    • A description of the danger the family member faces and how the danger is linked to your escape or cooperation with law enforcement;
    • Documentation of a previous grant of advance parole to a family member (if applicable); and
    • Any other credible evidence describing the danger of retaliation, including a signed statement from a law enforcement official, trial transcripts, court documents, police reports, news articles, copies of reimbursem*nt forms for travel to and from court, and affidavits from other individuals; and
  • If your eligible family member is inadmissible, an application for a waiver of inadmissibility on Form I-192.
